ADULT DRUG COURT STAFFING
Per West Virginia Code ยง49-4-103, an Adult Drug Court (ADC) is presided over by a current or senior status circuit judge or magistrate. Each presiding judge is approved by the chief circuit judge and is appointed by the Chief Justice in an Administrative Order of Appointment.
Each ADC must have a treatment team. The treatment team shall conduct a team meeting prior to each drug court session to discuss and provide updated information regarding the participants. After determining their progress or lack thereof, the drug court team shall recommend the appropriate incentive or sanction to be applied. If the treatment team cannot agree on the appropriate action, the judge shall make the decision based on information presented in the staffing.
Each ADC maintains a local advisory committee board. The advisory committee ensures the quality, efficiency, and fairness in planning, implementing and operating drug courts that serve the jurisdiction, and the provision of a full continuum of care for the participants.
