Supreme Court to Hear Recent Economic Development
Grant Committee Challenges

      Charleston, W. Va. - The West Virginia Supreme Court unanimously agreed today to expedite, consolidate, and hear oral arguments on October 10 at 9 a.m. in two recently filed challenges to the Economic Development Grant Committee process and the plans to issue bonds.

      The consolidated cases are: State of West Virginia ex rel Cities of Charleston and Huntington and its Counties of Ohio and Kanawha, West Virginia, Petitioners vs. West Virginia Economic Development Authority, a public corporation, Respondent AND State of West Virginia ex rel. Rev. Jim Lewis and John Cooney, Petitioners v. West Virginia Economic Development Grant Committee; West Virginia Economic Development Authority; City of Charleston; Kanawha County Commission; City of Huntington; and Ohio County Commission, Respondents.

      The first case was filed on August 25 and the second case was filed on September 9. The Court’s order granting review of the cases stated that it would "resolve all issues arising in the consolidated petitions with all deliberate speed."

      All motions to intervene or participate as amicus curiae, also known as "friend of the court," must be filed by September 22. The Court also required any other person having any interest or seeking to challenge any issue relating to the lawsuit or the bonds to file with the Court by September 22. The Court will consider these filings on September 23. All briefs are due on October 1.
